About this draft. This is a standalone Refund Policy for ease of reference at the point of sale and in the site footer. It is consistent with §5.4 of the Forever Linked Academy Terms of Service. In the event of any inconsistency, the Terms of Service prevail.
1. Who this policy is from
This Refund Policy is given by Oskr Pty Ltd (ABN 77 667 176 516), trading as Forever Linked Permanent Jewellery, in respect of subscriptions to and purchases of the Forever Linked Academy ("FLA") platform.
If you have any question about a charge or want to request a refund, contact us at support@foreverlinkedacademy.com before initiating any chargeback with your card issuer or bank.
2. Our position in plain English
By default, FLA does not give refunds for change of mind, lack of use, lack of perceived value, or any belief that FLA was not the right fit for you, once the billing period to which the fee relates has begun.
This applies equally to:
- monthly subscriptions (Spark, Flame, Blaze, Inferno)
- annual subscriptions (Spark, Flame, Blaze, Inferno)
- certification assessment fees (Foundation, Practitioner, Master) once assessment review has commenced
- certification renewal fees once the renewal period has begun
We disclose this position clearly at the point of sale, in our Terms of Service, and below. You acknowledge this position when you complete checkout.
3. Your statutory consumer rights are not affected
Nothing in this policy excludes, restricts, or modifies any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Consumer Rights Act 2015 (United Kingdom), or any other consumer protection laws that apply to you in your jurisdiction.
We acknowledge in particular that, where any of those laws applies to the services we supply to you:
- the services must be rendered with due care and skill
- the services must be reasonably fit for any purpose you have made known to us
- the services must match the description we have given them
If we fail to meet a statutory consumer right and that failure is not minor and not your responsibility, you are entitled to the statutory remedies — which, depending on the jurisdiction and the nature of the failure, may include a refund, repeat performance of the service, price reduction, or termination of the contract.
Australian consumers may also be entitled to compensation for any reasonably foreseeable loss or damage caused by a failure to meet a Consumer Guarantee under the Australian Consumer Law.
To make a statutory claim, contact support@foreverlinkedacademy.com with a description of the failure. We aim to respond within five business days and to resolve verified claims within 30 days.
4. United Kingdom — 14-day cancellation right and the immediate-access waiver
If you are a consumer in the United Kingdom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a 14-day cancellation right when you buy digital content online.
Because FLA is digital content that you can use immediately upon subscription, at checkout we will ask you either to:
- waive the 14-day cancellation right so that you can access FLA content immediately; or
- decline the waiver, in which case your access to paid content will be deferred until the 14-day period has expired.
If you waive the right and later wish to end your subscription within 14 days, the default position in §2 of this policy applies (no refund for change of mind), subject to your statutory rights described in §3.
5. Annual subscriptions — locked-in price, not locked-in access
Annual subscriptions are paid in advance for 12 months at a discount to the monthly equivalent. The annual subscription:
- locks in the price you paid for the 12-month period
- does not lock you into 12 months of access — you can cancel at any time
- continues to give you access until the end of the 12 months you have prepaid
- is not refunded pro-rata for the unused portion if you cancel early
The same statutory rights described in §3 apply to annual subscriptions.
6. Exceptions — when we will refund you
In addition to the statutory rights in §3, we will refund you in the following situations:
- Charge in error. If we have charged you in error — including by failing to act on a cancellation request you sent — we will refund the amount charged in error to your original payment method as soon as practicable.
- Duplicate charge. If your card has been charged more than once for the same subscription period, we will refund the duplicate amounts.
- Failed delivery of a paid service. If you have paid a fee for a specific service (for example, a Practitioner or Master assessment review) and we have not commenced that service within the timeframe set out in our Terms of Service, you may request a refund of that fee.
- Discretion. We may, at our sole discretion, offer a refund in circumstances that are not required by statute or covered above. Doing so on one occasion does not create any obligation to do so on another occasion.
7. Chargebacks
If you believe a charge is incorrect, please contact us at support@foreverlinkedacademy.com before initiating a chargeback with your card issuer or bank, and give us a reasonable opportunity to investigate and, if appropriate, refund the charge.
A chargeback initiated without us having had that opportunity may result in your FLA account being suspended until the dispute is resolved with the card issuer.
If your chargeback is upheld, the underlying charge is refunded by the card issuer and the suspension is lifted. If it is reversed, we may decline to reinstate your subscription without further payment.
8. How to make a request
To make any request under this policy, email support@foreverlinkedacademy.com with:
- the email address on your FLA account
- the date and amount of the charge
- a short description of the basis for your request
We will acknowledge your request within two business days and respond substantively within ten business days.
If you are not satisfied with our response, you may also lodge a complaint with:
- the Australian Competition and Consumer Commission or your state or territory consumer protection agency (Australia)
- Citizens Advice consumer service (United Kingdom —
citizensadvice.org.uk/consumer) - the Federal Trade Commission at
reportfraud.ftc.gov(United States) - the relevant consumer protection authority in your jurisdiction
9. Changes to this policy
We may update this Refund Policy from time to time. We will update the "Last updated" date at the top of this page and, where the change adversely affects you in respect of an existing subscription, we will give you at least 30 days' written notice before the change takes effect against you.
The current version of this policy is always published at foreverlinkedacademy.com/refund.
